New Delhi, Jul 11 – The Delhi High Court has issued an injunction against audio platform Kuku FM, prohibiting the release of new episodes of a specific audio series due to allegations of copyright and trademark infringement.
Justice Saurabh Banerjee delivered the ruling following a petition from rival audio platform Pocket FM, which accused Kuku FM of “wholesale and systematic copying” of its original content. This includes the unauthorized use of show titles, characters, posters, and entire storylines.
In the order dated July 10, the court instructed Kuku FM to refrain from airing any further episodes of the disputed shows and mandated the submission of details concerning the contested content.
Pocket FM’s petition also seeks approximately Rs 80 crore in damages, citing over 30 instances of unauthorized copying by Kuku FM. The petitioner, represented by senior advocate Amit Sibal and supported by law firm Shardul Amarchand Mangaldas, contended that it has invested years in developing a robust content strategy, which Kuku FM is allegedly exploiting for unfair commercial advantage.
